What is Identity Theft or Identity Fraud?

Identity theft or identity fraud is when someone intentionally assumes the identity of another individual and commits a fraudulent act. Generally, this takes the form of stealing another individual’s personal and/or financial information to use for their own personal gain.

Information that is commonly stolen during an ID theft case

Property affected by identity theft is more than just simple goods purchased with a stolen credit card. Identity theft can be perpetrated in an attempt to obtain access to someone's credit, purchase property, and other services. There have even been cases where an identity theft crime was perpetrated to obtain employment.

Degrees of Identity Theft

In New York, there are three degrees of identity theft: first, second, and third. Third degree identity theft is categorized as a Class A misdemeanor and is the lowest level of identity theft charge. Second and first degree identity theft are both felonies. Second degree ID theft is a Class E felony and will be charged when the amount of money associated with the theft is at least $500. First degree identity theft is the most serious charge, and is a Class D felony, and will be charged when the value associated with the theft exceeds $2,000.

The penalties of third degree ID theft include:

  • Up to 1 year in jail
  • Up to $1,000 in fines, or double the value of the affected property

The penalties of a second degree ID theft include:

  • Up to 4 years in jail
  • Up to $5,000 in fines, or double the value of the affected property

The penalties of a first degree ID theft include:

  • Up to 7 years in jail
  • Up to $5,000 in fines, or double the value of the affected property

The circumstances of your case will determine how prosecutors charge you. The prosecutors have the burden of proof. They must prove that the defendant in question assumed the stolen identity and knowingly attempted to defraud. The mere possession of stolen credit cards does not qualify for an identity theft charge.
