Type Of Vehicular Assault
Vehicular assault is a complex legal matter involving a number of important factors. There are three types of vehicular assault under New York law:
- Second-degree vehicular assault: You can be charged with this offense if you harm someone while operating a vehicle under the influence of drugs or alcohol. You can also be charged with this crime if you harm someone while driving a large vehicle carrying hazardous materials or if you are driving an ATV or snowmobile while intoxicated. If convicted, you could be sentenced to up to four years in prison.
- First-degree vehicular assault: This offense applies to drivers who commit second-degree vehicular assault, but do so while extremely intoxicated. You can also be charged with first-degree assault if you harm more than one person or if you have a previous drunk driving charge on your record. The possible sentence for this offense includes up to seven years in prison.
- Aggravated vehicular assault: This charge is reserved for those who meet the standard for first-degree vehicular assault, but do so in a manner that unreasonably endangers drivers or interferes with traffic. Those convicted could be sentenced to up to 15 years in prison.
Each of these charges carries serious consequences even beyond imprisonment and fines, including the loss of one's career, loss of time spent with one's family and a long-term difficulty finding future employment.
