Sentencing For Vehicular Manslaughter
The penalties for vehicular manslaughter are severe, and the cases surrounding such charges can be complex and time-consuming. In general, the offense can be split into two degrees:
- Second-degree vehicular manslaughter occurs when a driver accidentally causes the death of another person as the result of intoxication by drugs or alcohol. This law applies to ATVs and snowmobiles as well as cars and trucks.
- First-degree vehicular manslaughter is applicable in cases of extreme intoxication — .18 percent blood alcohol content or higher. It may also be used in cases involving multiple fatalities, cases in which the driver had a suspended or revoked license, or if the suspect has a previous conviction for a similar offense in the past.
Both offenses are felonies with severe consequences applied upon conviction. Second-degree vehicular manslaughter is punishable by up to seven years in prison and fine of up to $5,000. Those convicted of first-degree vehicular manslaughter could face up to 15 years' imprisonment.
