Have you been charged with driving while ability impaired by drugs (DWAI) in New York? If so, I can help. I am Brooklyn DWAI-drugs defense attorney Wilson LaFaurie, and my New York law firm is dedicated to providing strong, effective and experienced advocacy to individuals charged with drunk driving, driving under the influence of drugs and other offenses. A former assistant district attorney, I have 17 years of experience in this area of law.
DWAI-Drugs Charges Versus DWAI-Alcohol Charges
Being charged with DWAI-drugs is a much more serious matter than being charged with DWAI-alcohol. A first or second DWAI-alcohol offense is only considered a traffic infraction, not an actual crime. However, a first DWAI-drugs offense is considered a misdemeanor crime and a second offense is a felony crime.
The penalties for a first DWAI-drugs conviction are the same as those for a first DWI. These can include:
- Up to one year in jail
- Mandatory suspension of your driver's license for at least six months
- Between $500 and $1,000 in fines
- Increased insurance rates
These penalties could represent a serious disruption in any person's life. Between the mandatory loss of driving privileges, the potential for jail time and the heavy financial burden brought by fines and increased insurance, many convicted of DWAI-drugs face significant challenges.
The consequences of a DWAI-drugs conviction are not limited to the judgment handed down by the court. If convicted, you could face additional losses as well. If, for example, your job requires you to drive, having a misdemeanor or felony conviction on your driving record can result in the loss of your career. It can also negatively affect your eligibility for student loans, future employment and much more.
As your attorney, I will do everything possible to help you avoid these long-term consequences. I understand the challenges you face and the effects a conviction could have on your life. When you contact my law firm, I will meet with you one-on-one to discuss your case and develop an effective defense strategy.
Former New York Prosecutor
At the beginning of my legal career, I worked as an assistant district attorney for Kings County and Brooklyn. During this time, I developed a deep understanding of the tactics used by New York prosecutors on DWI and DWAI cases. Today, I use that knowledge to provide insightful representation that anticipates the behavior of the other side.
In many cases, I am able to resolve the issue by negotiating a favorable settlement with prosecutors. If this is not possible, however, I am always prepared to go to trial to protect my client's rights and interests. No matter how challenging your case becomes, I will stand by your side throughout the entire process.
