What's the Penalty for a First DWI?

If this is the first time you have been charged with a DWI, you may be facing penalties of up to 12 months in jail, the suspension of your driver's license for at least six months, and between $500 and $1,000 in fines. This does not include other negative effects, such as increased insurance rates and a negative blot on your driving record.

What Happens if I Get a Second DWI?

A second DWI is considered a felony offense and carries a minimum of five days of jail time and a maximum of four years in prison. In addition, you will lose your driver's license for up to 12 months and have to pay between $1,000 and $5,000 in fines.

In New York, you may also be required to submit to an alcohol evaluation, in which counselors will likely try to assign you to a treatment program. I work hard to help get people out of those programs and stay out.

How Fast Can I Get My Car Back From the City?

It might take someone with no knowledge of DWI law a month or more to get a vehicle back from the city. However, a skilled attorney can often do so much faster. In general, you must:

  • Pay the impound fee
  • Show that you do not need an alcohol treatment program
  • Affirm that you will not sue the city for any damage to your car

What if I Have a Commercial Driver's License (CDL)?

If you have a CDL, there is much more at stake than just losing your license. Your entire livelihood depends upon being able to drive a commercial vehicle. Although many attorneys have a basic understanding of DWI law, protecting a CDL calls for a real ability to litigate and a determination to not back down or compromise in court.
