New York City Murder/Manslaughter Lawyer
If you have been charged with murder, you need a lawyer on your case from day one. Mistakes made early in your case can result in wrongful conviction and a lengthy prison sentence for something you didn't even do. Fewer than 5 percent of all criminal lawyers have ever tried a single case involving a homicide. I have represented defendants accused of murder spanning New York State, including Brooklyn, New York, Queens, Suffolk, Nassau and the Bronx.
I am criminal defense attorney Wilson LaFaurie. From my law office in Brooklyn, I represent clients throughout the New York City area who face murder charges, including manslaughter and negligent homicide. The legislature in the State of New York and the common law have carved the following defenses: justification, alibi, extreme emotional disturbance, insanity and renunciation. Each and every one of these defenses must be contemplated when confronting a murder/manslaughter charge.
I am a former Assistant District Attorney and in my current Boutique Law offices, I have 17 years of experience in handling the following Homicide/Murder offenses:
-Criminally Negligent Homicide--Penal Law 125.10
-Aggravated Criminally Negligent Homicide--Penal Law 125.11
-Vehicular Manslaughter in the First & Second Degree--Penal Law 125.12 & 125.13
-Manslaughter in the First & Second Degree--Penal Law 125.15
-Aggravated Manslaughter in the First & Second Degree--Penal Law 125.21 & 125.22
-Murder in the First & Second Degree--Penal Law 125.25 & 125.26
Don't Speak to Police Without a Lawyer Present
Murder in New York is punishable by a prison sentence of 15 to 25 years to life. Manslaughter, which is causing someone's death without the intent of killing them, is punishable by 15 to 25 years in prison. Vehicular manslaughter, which is causing a person's death by recklessness such as driving while intoxicated or discharging a firearm into the air, is punishable by up to 15 years in prison.
When so much is at stake, you should not say anything to police before speaking to an attorney. Police may say they only want to get your side of the story. However, police usually know more than they are telling you. There is nothing you can say that will help your case, and you could end up giving police the evidence they need to charge you. Once you have a lawyer present, police questioning will stop.
Don't Agree to a Police Lineup Without Your Attorney Present
If you have been charged with murder, the first thing I would do as your attorney is call the police precinct and make sure you do not appear in a lineup without me being present. Eyewitness identification is notoriously inaccurate, and the tendency to make a false identification is much greater when police stack the deck against you by making you appear in a lineup with people who do not look like you. Many experts have written books on these procedures. See "Eyewitness Testimony" by Elizabeth F. Loftus and "Witness for the Defense" by Katherine Ketcham.
If I am with you at the police lineup, then I can get any identification thrown out before the arraignment or grand jury indictment.
