The state of New York takes domestic violence cases very seriously. If police are called to your home and find evidence of abuse, somebody is going to jail that night, usually the man.

One of the first courts established to deal with family violence was the Felony Domestic Violence Court in Brooklyn in 1996. I was the prosecutor in that court. Using the experience I gained as a prosecutor, I went on to successfully defend more than 1,200 individuals charged with offenses such as aggravated harassment, menacing, assault, violation of orders of protection and attempted assaults.

Today, New York state has more than 40 IDV (Integrated Domestic Violence) courts. The dedicated resources that the state of New York has invested in these courts makes it even more important to retain an attorney who understands how to prepare a strong defense. These courts can become very complicated, frustrating and confusing to the novice attorney or the lawyer who does not regularly practice within this hybrid civil-criminal court system.

Dealing With Orders of Protection

IDV courts also handle orders of protection, also known as restraining orders. You may be subject to a restraining order before you are found guilty of any charges.

If you are subject to a restraining order, it important not the contact the victim. Violation of a restraining order is a crime of its own and can result in your incarceration. Instead, contact an attorney and let him or her contact the victim for you.
